Welcome to PetTrials ("Platform", "we", "us", "our"), a service operated by Altered Carbon Synthetic Biology Pty Ltd (ACN 649 555 993) ("Altered Carbon"). By creating an account, accessing, or using the Platform at pettrials.com.au, you ("User", "you", "your") agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
1. About the Platform
PetTrials is a clinical trial matching service that connects companion animal owners with veterinary research studies conducted by Australian universities and research institutions. PetTrials is not a veterinary practice, does not provide medical advice, and does not conduct clinical trials.
2. Eligibility
You must be at least 18 years of age and a resident of Australia to use PetTrials. By creating an account, you represent that you are the legal owner or authorised carer of any animals registered on the Platform.
3. Account Registration
To access core features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your password and for all activity under your account. You agree to notify us immediately of any unauthorised use.
Altered Carbon reserves the right to suspend, terminate, or refuse to create any account that violates these Terms or that is identified as belonging to a Restricted Party (defined in section 8 below).
4. Pet Health Profiles
You may upload your pet's health information, veterinary records, and related documents ("Pet Data") to create a health profile. You represent that all information provided is accurate to the best of your knowledge. Pet Data is used solely for the purpose of matching your animal with relevant clinical trials.
5. Clinical Trial Matching
PetTrials arranges introductions between pet owners and research institutions. We do not guarantee that your pet will be matched with a trial, that your pet will meet eligibility criteria, or that any particular outcome will result from trial participation. All trial participation decisions are made between you and the research institution. Participation in any clinical trial is entirely voluntary.
6. No Veterinary or Medical Advice
Nothing on the Platform constitutes veterinary advice, diagnosis, or treatment recommendations. Always consult a qualified veterinarian regarding your pet's health. PetTrials does not endorse or recommend any specific trial, treatment, product, or institution.
7. For Researchers and Institutions
Research institutions may list clinical trials on PetTrials at no cost. By listing a trial, institutions represent that the study has received appropriate ethics approval from a recognised Animal Ethics Committee (AEC) under the Australian Code for the Care and Use of Animals for Scientific Purposes. Altered Carbon reserves the right to remove any listing at its discretion.
8. Restricted Parties
Access by Restricted Parties is not permitted
Altered Carbon maintains a list of specified entities and their related persons ("Restricted Parties") that are not permitted to access or use the Platform. The identity of Restricted Parties is held by Altered Carbon and may be disclosed to a specific person where Altered Carbon reasonably considers that person to be acting on behalf of a Restricted Party.
Restricted Parties include any specified entity, its related bodies corporate (within the meaning of the Corporations Act 2001 (Cth)), and the directors, officers, employees, contractors, and agents of those entities.
You agree that you will not register an account, upload Pet Data, list a trial, contact research teams via PetTrials, or otherwise access the Platform if you are a Restricted Party, or if you are acting on behalf of, at the direction of, or for the benefit of a Restricted Party. Use of proxy registrations or third parties to circumvent this restriction is a breach of these Terms.
Altered Carbon may in its sole discretion suspend or terminate any account that it identifies as belonging to, acting on behalf of, or providing access to a Restricted Party, and may retain identifying details associated with such accounts (including name, contact information, IP address, and registration metadata) for up to seven years for fraud-prevention, breach-of-Terms, and dispute purposes.
9. Intellectual Property
All content, design, logos, trade marks, and software associated with PetTrials are the property of Altered Carbon Synthetic Biology Pty Ltd. You may not reproduce, distribute, or create derivative works from Platform content without prior written consent. You retain ownership of any Pet Data you upload.
10. Privacy
Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, store, and protect your personal information and Pet Data. By using the Platform, you consent to the practices described in the Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by Australian law, Altered Carbon and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, participation in any clinical trial, or reliance on any information provided through PetTrials. Our total liability for any claim arising from these Terms shall not exceed AUD $100.
12. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure. We do not warrant the accuracy, completeness, or reliability of any trial listing, match, or information provided by third-party institutions.
13. Indemnification
You agree to indemnify and hold harmless Altered Carbon, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, or expenses arising from your use of the Platform, your violation of these Terms, your status as a Restricted Party or as a person acting on behalf of a Restricted Party, or your participation in any clinical trial.
14. Modifications
Altered Carbon reserves the right to modify these Terms at any time. Material changes will be communicated via email or through a notice on the Platform. Continued use after changes constitutes acceptance of the updated Terms.
15. Termination
You may close your account at any time by contacting us. Upon termination, your Pet Data will be deleted within 30 days unless retention is required by law, by these Terms (including section 8), or for legitimate business purposes such as resolving disputes or enforcing our Terms. Altered Carbon may suspend or terminate your account for violation of these Terms.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia sitting in Victoria. Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law.
